CNN —For the fourth time since she became the federal government’s top Supreme Court advocate, Solicitor General Elizabeth Prelogar is arguing an abortion-related case. When Prelogar argues before the Supreme Court, she is arguing in front of several alumni of the US Office of the Solicitor General. She also clerked for her current boss, Attorney General Merrick Garland, when he was a DC Circuit judge, before her Supreme Court clerkships. She went on to litigate Supreme Court cases for private firms and worked on special counsel Robert Mueller’s investigation. Likewise, the abortion case Prelogar argued last month could have significant consequences for federal power.

Joe Biden and Donald Trump are set to face off in the first presidential rematch since 1956. It’s that a lead of any margin for Trump was unheard of during the 2020 campaign – not a single poll that met CNN’s standards for publication showed Trump leading Biden nationally. CNN —Former President Donald Trump is the closest thing in modern political history to an incumbent who doesn’t hold the office. But these considerable advantages also raise questions about his general election chances given his inability to completely win over Republican primary voters. Despite effectively clinching the Republican nomination with a near-sweep of Super Tuesday states, Trump couldn’t escape the shadow cast by former South Carolina Gov. Haley dropped out Wednesday after consistently winning 30% or so of the GOP primary vote in the states she competed in. Undoubtedly some of the Republican voters who backed Haley in the primaries and caucuses will return to the Trump fold in November, maybe even a majority.

The most important message from the primaries is the most straightforward: Trump’s coalition is the dominant faction in the GOP. Like McConnell’s announcement, the choices by GOP elected officials in the primary contest signal their acknowledgement of the party’s direction. The share of GOP elected officials who have endorsed Haley isn’t anywhere near as large as her share of the total vote. But a deeper factor also explains the imbalance in support among GOP elected officials.

Polling in Michigan and many of the Super Tuesday states suggests the results will get increasingly worse for Haley from here. And given the deep commitment so many delegates have to Trump, Haley stretching out a long negative primary does not make her a likely Trump emergency replacement. In the coming days, Haley will hear from many Republicans who don’t want the Republican primary to end any time soon. But past primaries have gone on longer because other candidates have kept winning; Haley has no wins on the horizon.

WASHINGTON (AP) — The top vote-getter in Tuesday’s Republican presidential primary in Nevada wasn’t former U.N. Instead, Nevada voters mounted a ballot-box protest and gave the most votes to “None of these candidates,” a ballot option required by state law. At the time the race was called, “None of these candidates” led with about 60% of the vote. Initial returns showed “None of these candidates” leading in seven counties that Trump carried in his 2016 Nevada caucus win. The Nevada Republican Party opted to hold a presidential caucus Thursday to award delegates and has essentially disavowed the primary.

But it also sets the stage for additional appeals from the Republican ex-president that could reach the U.S. Supreme Court and result in further delays. The judges gave Trump until February 12 to ask the Supreme Court to pause the ruling. The appeals court took center stage in the immunity dispute after the Supreme Court in December said it was at least temporarily staying out of it, rejecting a request from Smith's team to take up the matter quickly and issue a speedy ruling. But the court could yet still decide to act on a Trump team appeal, adding to the uncertainty of a trial date. The high court declined the request, leaving the matter with the appeals court.

Circuit holds that Trump cannot invoke immunity as a defense against charges connected to his attempts to overturn the 2020 presidential election and a violent insurrection at the Capitol on Jan. 6, 2021. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” the panel’s ruling states. “The Indictment charges that former President Trump violated criminal laws of general applicability,” the opinion states. The panel ruling was unanimous and effectively bipartisan, with Democratic- and Republican-appointed judges in agreement. Such an appeal would continue a stay of the panel’s ruling until the high court acted.

Trump has pledged to appeal and has until Monday to ask the Supreme Court to temporarily block the ruling. Perhaps to speed things along, the appeals court established a quick schedule for Trump to respond to Tuesday’s ruling, giving Trump until February 12 to file an emergency stay request with the Supreme Court. The Supreme Court, however, can take as long as it likes at each step. The cases are entirely separate – this is a criminal prosecution against Trump, and the upcoming Supreme Court case is a civil attempt to remove Trump from state ballots. Further, the appeals court’s findings and explanations in Tuesday’s ruling are not binding on the Supreme Court.
